1. Sweepstakes Period: The Red Man Moist Snuff Always Fresh Sweepstakes (the "Sweepstakes") begins at 12:00:01 p.m. Eastern Time ("ET") on February 01, 2011 and ends at 11:59:59 a.m. ET on September 29, 2011 (the "Sweepstakes Period").
   
   
2. How To Enter: There are 2 ways to enter: 1) Visit www.RedMan.com (the "Site") and either register with all required registration information or log-in if you're a returning user with your email address and password. During the Sweepstakes Period, after registering/logging in, click the Sweepstakes link and vote for your favorite monthly prize being offered ("Entry"). 2) If you do not wish to enter by visiting the Site but still wish to enter this Sweepstakes, you may do so by hand printing your first name, last name, address, city, state, zip code, date of birth, email address (optional) , vote for your favorite prize offered for the month you are entering – see Rule #4 below (optional) and telephone number (optional), on a 3" X 5" paper and mailing the paper in a hand-addressed stamped envelope, to: The Red Man Moist Snuff Always Fresh Sweepstakes, P.O. Box 7877, Melville, NY 11775-7877. All mailed entries ("Entry") must be postmarked by end of each month and must be received within 7 days of the end date for each month in order to be included in that month's drawing. Limit one Sweepstakes Entry per person/email address/household regardless of method of Entry per day ("Entrant"). More than one Entry from any person per day will be void. Mailed Entries must be complete in order to be eligible. All eligible Entries received will be automatically entered into subsequent monthly drawings for the prizes being offered each month. The vote submitted by Entrants for previous months will not be taken into account for future monthly prizes offered. The monthly prize that receives the most votes for that month will be the prize awarded that month. Normal Internet access and usage charges imposed by your on-line service provider will apply. All entries become the property of Pinkerton Tobacco Co. LP ("Sponsor").
   
   
3. Random Drawing: There will be one (1) Monthly Prize winner selected in a random drawing on or about 15 business days after the end date of each month from among all eligible entries received each month, and prior months, if any, during the Sweepstakes Period. Random drawing will be conducted by Don Jagoda Associates, Inc., an independent judging organization whose decisions are final on all matters relating to this Sweepstakes. Odds of winning will depend upon the number of eligible Entries received at the time of each drawing. Prize will be awarded and winners will be notified by phone and email.

   Each Monthly winner will be notified by phone, mail and/or e-mail. Prizes are awarded "as is" with no warranty or guarantee, either expressed or implied by Sponsor. Limit one prize per person/household. Sponsor-specified prizes may require winner to participate in or obtain safety training courses/safety equipment during pick-up/delivery of prize award. Winner are solely responsible for income and other taxes and all appropriate vehicle insurance, licensing, registration and title fees, if applicable and will be required to show proof of insurance and a valid U.S. driver's license prior to taking delivery of Sponsor-specified prizes. The ARV of prizes listed are subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the ARV is estimated for purposes of these Official Rules, and the date the prizes are awarded. If the actual purchase price of prizes is less than the ARV stated herein, the prize winners will NOT be entitled to a check, cash or other form of payment for the price difference. Prizes are not transferable. No substitution or transfer of prize permitted except at the sole discretion of the Sponsor who reserves the right to substitute a prize (or portion of prize) of equal or greater value in the event the prize is unavailable. In the event a prize is not available to winner based on his/her place of residence, Sponsor will award a prize of equal or greater value. No cash redemption of prizes, except at Sponsor's sole discretion. Taxes related to the prizes are the responsibility of the winners. 5. Eligibility: Open to legal residents of, and currently residing in, the contiguous 48 United States and the District of Columbia (excluding residents of VA, MA & MI), who are tobacco consumers, 19 years of age (21 years of age in MS) and older as of date of Entry. Employees of Sponsor and any of its affiliates, parents or subsidiaries, respective parent, subsidiary, and affiliate companies and advertising and promotion agencies, persons engaged in the development of Sweepstakes materials or events, and Don Jagoda Associates, Inc., and members of their immediate families (spouses, parents, children, and siblings and their spouses) living in the same household of each are not eligible. Void in VA, MA & MI and where prohibited by law and subject to all federal, state and local laws.
   
   
6. General Rules: Potential winners will be required to sign and return an Affidavit of Eligibility, liability/publicity release (except where prohibited by law) ("Affidavit Package") within ten (10) days of notification attempt or the prize will be forfeited and alternate winner may be selected. Return of prize or prize notification as undeliverable may result in disqualification and alternate determination. A 1099 tax form will be submitted on each winner's behalf by Sponsor for the actual value of the prize awarded. Acceptance of prize constitutes permission to use winners' names and likenesses for promotional purposes without further compensation except in Tennessee and wherever else prohibited by law. Sponsor may arrange a Sponsor-specified photographer be present when prize is awarded for promotional photos, these photos may be used for advertising/promotional purposes, which Sponsor has the right to edit, reformat, or modify, in Sponsor's sole discretion. By Entering, entrants accept and agree to be bound by these Official Rules and the decisions of the judges. Winners and all entrants, as a condition of Entry into the Sweepstakes, agree to release Sponsor, Don Jagoda Associates Inc., their respective parents, subsidiaries, affiliated companies, promotion agencies ("Administrators") and each of their respective officers, directors, shareholders, members, employees, agents, assigns and all others associated with the development and execution of this Sweepstakes from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with submitting an Entry or otherwise participating in any aspect of the Sweepstakes, the receipt, ownership or use of any prize awarded or any typographical or other error in these Official Rules or the announcement of offering of prizes. Entries generated by script or bot are not eligible. Sponsor reserves the right to cancel, terminate or modify the Sweepstakes if it cannot be completed as planned for any reason, including for infection by computer virus, bugs, tampering, unauthorized intervention, technical failures, or corruption of any sort. In such event, Sponsor will award the prize from among all eligible Entries received prior to the cancellation/termination of the Sweepstakes. As a condition of entering the Sweepstakes, participant agrees that: 1) under no circumstance will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for out-of-pocket expenses; 2) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and 3) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees.
   
   
7. Travel General Rules: Airline tickets are for travel from major airport in the United States nearest winner's home to trip destination. Airline carrier's regulations and conditions apply. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Winner's guest must be 19 years of age or older and (parent/legal guardian if guest is a minor) will be required to execute a Release of Liability prior to departure. Winner/guest(s) will be required to agree to and abide by terms of participating excursions or events (if any). Winner and his/her guest(s) must possess valid travel documents (i.e., valid passport, government-issued photo ID, etc.) in order to travel. All travel must be completed on dates specified by Sponsor or within one year of prize award (based on the prize that is awarded) or prize will be forfeited. Car/RV rental is subject to additional restrictions set forth by the car/RV rental contract. If Winner(s) does/do not meet car requisites/requirements, that portion of the prize will not be awarded and no additional compensation will be provided. If Winner does not meet RV requisites/requirements, an alternate prize of equal or greater value may be awarded. Winner(s) is/are responsible for returning the car/RV with a full tank of gas. Winner(s) is/are responsible for arranging all insurance and liability with the car/RV rental agency upon pick-up of car/RV rental. Winner(s) is/are responsible for any damage to the car/RV rental during the trip. Participation in the Richard Petty Driving Experience is subject to advance confirmation and availability of the program and winner and guest must possess a valid U.S. driver's license, be able to operate a manual transmission vehicle, fit through a 15" x 30" window (since there are no doors), weigh no more 280lbs (varies on how the weight is carried) and not exceed 6'8" in height (or that portion of prize will not be awarded and no additional compensation will be provided). All standard terms and conditions apply to the Richard Petty Rookie Driving Experience. Additional releases and/or waivers of liability required by the International Speedway Corporation and/or any applicable sanctioning body shall also be required as appropriate in order to use prize. Certain restrictions and blackout dates apply. Seat selection and timing of trip subject to availability and confirmation of reservations. No refunds or credit for changes are allowed. All other expenses and costs, not expressly listed above, including, but not limited to, taxes, tips, entertainment and transfers, are the winner's sole responsibility. In the event any winner or his/her guest(s) engages in behavior that (as determined by Sponsor, in Sponsor's sole discretion) is obnoxious or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the trip or other applicable experience early, in whole or in part, and send the winner(s) and his/her guest(s) home with no further compensation. In the event any excursion or event cannot take place as scheduled for reasons out of Sponsor's control, that portion of prize will be forfeited and no additional compensation will be provided.

Limit one (1) entry per person/email address. Normal Internet access and usage charges imposed by your on-line service provider will apply. All entries become the property of Pinkerton Tobacco Co. Sponsor and its Administrators are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications, whether caused by the sender, by any of the equipment or programming associated with or utilized in this Sweepstakes which may limit the ability to participate, or by any human error which may occur in the processing of the entries in this Sweepstakes. Entries generated by script or bot are not eligible. Sponsor reserves the right to cancel, terminate or modify the Sweepstakes if it cannot be completed as planned for any reason, including for infection by computer virus, bugs, tampering, unauthorized intervention, technical failures, or corruption of any sort. In such event, Sponsor will award the prize from among all eligible entries received prior to the cancellation/termination of the Sweepstakes. As a condition of entering the Sweepstakes, participant agrees that: 1) under no circumstance will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential or any other damages, other than for out-of-pocket expenses; 2) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and 3) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees.
